Please read before sending. This covers how we work together.
1. Services. TES Digital Group ("we," "us"), a service of The Electronics Store, Kansas City, MO, builds and maintains websites, registers domain names, and provides hosting management for clients ("you"). The scope of your website is what we agree on in writing (including text or email). Additional pages, features, or revisions beyond the agreed scope may be billed separately at rates quoted in advance.
2. Domain names. We register your domain name on your behalf through our registrar account, listing you as the registrant contact. While your account with us is active and in good standing, we manage the domain for you. You may request transfer of the domain to your own registrar account at any time, and we will complete the transfer promptly at no charge beyond any registrar fees, provided your account balance is paid in full. Domain registrations renew annually and are billed to you in advance; if a renewal fee goes unpaid, the domain may expire and become available to the public, which we cannot reverse.
3. Hosting and billing. Hosting and maintenance are billed monthly or annually in advance at the rate we quote you. Rates for renewal periods may change with at least 30 days' notice. If payment is more than 15 days past due, we may suspend the website until the balance is paid. If payment is more than 60 days past due, we may take the site offline and cancel services. You may cancel at any time with written notice; fees already paid for the current billing period are not refunded, and your site remains live through the end of that period.
4. Your content. You are responsible for the accuracy and legality of all content you provide — text, photos, logos, pricing, and claims about your business. You confirm you own or have permission to use everything you send us. You keep ownership of your content and logo. We may decline to publish content that is unlawful or that we reasonably believe infringes someone else's rights.
5. Our work. Upon full payment, you receive a license to use the completed website for your business. Design work, code, and templates we create remain our property to reuse in other projects. We may display your finished website in our portfolio unless you ask us not to.
6. Third-party services. Websites depend on third-party providers (hosting platforms, domain registrars, form services, email providers). We choose reputable providers but do not control them and cannot guarantee uninterrupted uptime, and we are not liable for outages, data loss, or changes caused by those providers.
7. No performance guarantees. We build professional websites, but we do not guarantee search engine rankings, website traffic, leads, or sales results.
8. Limitation of liability. To the fullest extent permitted by law, our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits.
9. Changes and governing law. We may update these terms with notice to you; continued use of our services after notice means you accept the updated terms. These terms are governed by the laws of the State of Missouri.
